CirculeID プラットフォームの利用は何によって規律されますか。
署名済みの基本契約書とその注文書、およびそれらに添付されたデータ処理条項です。CirculeID はクリックスルー条項ではなく個別交渉によるエンタープライズ契約で提供されるため、別途公開される利用規約は適用されず、本ウェブサイト上のいかなる記載も貴社が署名した内容に優先しません。
That is worth stating plainly, because a published terms page that contradicts a negotiated agreement causes real problems during procurement — and the signed document wins in any event.

Your data is yours. We process it to provide the service and for nothing else. We do not use customer product data to train models, and we do not aggregate it into a data product sold to third parties. This is a contractual commitment, not a policy page.
Export is defined, not discretionary. The agreement states the export window and the format. Because passports are expressed in GS1 and W3C standards, what you export stays meaningful and verifiable outside our platform.
Subprocessor changes are notified in advance. Not announced afterwards, so you have the opportunity to object before a change takes effect.
Availability commitments live in the agreement. Deliberately not on a marketing page: a figure with no contract behind it is not a commitment, and we would rather negotiate a real one against your requirements.

貴社が署名する契約の中にあります。CirculeIDはクリック同意型の規約ではなく、交渉に基づく基本契約のもとで提供されます。ここに別建ての規約を載せれば、食い違い得る文書が二つできるだけで、しかも署名済みの契約が優先します。本ページは、その契約が法務部門に届く前に何を想定しておけばよいかをお伝えするものです。
2つの文書が矛盾する場合、どちらが優先しますか。
優先順位は契約書自体に定められており、通常は次の順です。注文書、次に基本契約書、次にデータ処理条項、次に参照により組み込まれた各種ポリシー。貴社の調達プロセス上その順序を変える必要がある場合は、交渉が可能です。
当社がプラットフォームに投入したデータは誰のものですか。
貴社です。当社はサービス提供のためにのみ処理します。顧客の製品データをモデルの学習に使うことはなく、他社に販売する製品へ集約することもありません。これは方針表明ではなく契約上の約束であり、契約書に明記されています。
契約が終了した場合、パスポートはどうなりますか。
エクスポートしていただきます。GS1 と W3C の標準で表現されているため、書き出された文書は当社のプラットフォームの外でも意味を持ち、検証可能なままです。契約書でエクスポート期間と形式を定めます。解約時ではなく調達の段階でご確認ください。
署名前に修正履歴付きの版をもらえますか。
はい。契約は交渉可能です。全員が時間を投じた技術評価の後で法務が障害を見つけるより、早い段階で修正案を入れていただくほうがよいと考えています。プロセスの初めに契約書をご請求ください。
